Description

Dirty Broom Theory Reconstructing Law Enforcement Integrity, Procedural Contamination, and the Reliability of Criminal Judgments Can justice truly be considered reliable when the very institutions responsible for enforcing the law are compromised by corruption, abuse of authority, manipulation of evidence, or conflicts of interest? Dirty Broom Theory advances a critical proposition: a dirty broom cannot produce clean justice. The theory challenges the assumption that criminal judgments are necessarily legitimate merely because they are delivered through formally established legal procedures. When law enforcement officials compromise the integrity of the criminal process, the contamination may extend beyond individual misconduct, undermining the reliability of evidence, the fairness of proceedings, and the legitimacy of judicial decisions. Through an interdisciplinary approach, this book examines the relationship between law enforcement integrity, procedural contamination, and the reliability of criminal judgments. It develops a conceptual framework for identifying integrity violations, assessing their connection to criminal cases, evaluating their material impact on the proceedings, and determining when such violations create reasonable doubt about the reliability of a judgment. Going beyond the conventional understanding of procedural legality, this work calls for a more substantive approach to criminal justice—one that places integrity, accountability, and evidentiary reliability at the center of legal evaluation. Dirty Broom Theory offers a conceptual foundation for rethinking law enforcement accountability and strengthening the legitimacy of criminal justice. Its central message is clear: justice cannot be separated from the integrity of those entrusted to administer it.
